Presentation title: Practical application of ECHR human rights standards on extradition cases
 
Established in 1959, the European Court of Human Rights (ECtHR) oversees the implementation of the European Convention on Human Rights in the forty-six Council of Europe Member States.  Applications can be individual (ie. made by any person, group of individuals, company or NGO) or inter-State. 
 
The ECtHR may indicate interim measures to any State party to the Convention. Interim measures are urgent measures which apply only where there is an imminent risk of irreparable harm. Such measures are decided in connection with proceedings before the Court without prejudging any subsequent decisions on the admissibility or merits of the case in question. The majority of cases where interim measures are applied concern either expulsion or extradition, and would normally consist of a suspension of the applicant’s expulsion or extradition for as long as the application is being examined.
 
The webinar will include the following topics:

  • General overview of the ECtHR and the Convention

  • Overview of interim measures and how they relate to extradition/expulsion cases

  • Link to Article 2 and Article 3 rights

  • Operational overview of what States can include in their extradition requests to pre-empt potential challenges and to reduce the risk of a request being unsuccessful.

 
This webinar will be held in English and no interpretation will be provided. All attendees will receive a certificate of attendance. The webinar is open to all IAP organisational and individual members.
